Permission From the Arbitration Council
Under Section 6 of the Muslim Family Laws Ordinance 1961, a man who is already married must obtain written permission from the Arbitration Council before contracting a second marriage. Without this permission, the Nikah Registrar can still register the Nikah Nama, but the husband becomes liable to pay the entire prompt dower to the existing wife/wives immediately, and may face a fine and imprisonment on conviction.
How the Permission Process Works
- An application is submitted to the Chairman of the Arbitration Council (typically the local Union Council).
- The existing wife (or wives) is given an opportunity to be heard.
- The Council considers whether the second marriage is necessary and just.
- Permission is granted or refused; either party may have recourse to further proceedings if aggrieved.
