Online Nikah Second Marriage: Permission From the Arbitration Council
Under Section 6 of the Muslim Family Laws Ordinance 1961, a man who is already married must obtain written permission from the Arbitration Council before contracting a second marriage. This applies whether the second Nikah is planned in person, online, or through a Vakeel — the requirement is about the marriage itself, not the format of the ceremony.
Without this permission, the Nikah Registrar can still register the Nikah Nama for the second marriage — the marriage itself remains valid religiously and is not voided. However, skipping the Arbitration Council step triggers real consequences: the husband becomes immediately liable to pay the entire prompt dower (Mahr) to his existing wife or wives, and on conviction he can face a fine and imprisonment of up to one year, or both.
How the Second Marriage Permission Process Works
- Application submitted. The husband applies to the Chairman of the Arbitration Council, which is typically constituted at the local Union Council level, stating the grounds for the intended second marriage.
- Existing wife notified. The application is communicated to the existing wife (or wives), who is given a genuine opportunity to be heard on the matter before any decision is made.
- Council considers the grounds. The Arbitration Council examines whether the second marriage is necessary and just, weighing factors that have historically included the existing wife’s infertility, serious illness, or other significant circumstances, though the Council retains discretion to assess each case on its facts.
- Permission granted or refused. The Council issues its decision. If either party is dissatisfied, there is recourse to further legal proceedings, since the Arbitration Council’s decision is not automatically final and unreviewable.
What This Means Practically for Your Online Nikah
If you’re planning a second marriage, the safest and least costly path is to complete the Arbitration Council process before the Nikah, not after. Trying to solemnize the Nikah first and sort out permission later exposes you to the dower and penal consequences above, and can create friction with the existing wife’s family that a properly followed process is designed to avoid.
