Is Online Nikah Possible Under Pakistani Law?

Minimum Marriage Age for Online Nikah in Karachi
Karachi is governed by Sindh law. Under the Sindh Child Marriages Restraint Act, 2013, the minimum marriage age is 18 years for both parties. Age and identity should therefore be verified before any Nikah or Wakalatnama arrangement is prepared.

2. Wakalatnama Review Where Required
If one party cannot attend, the authority given to a representative should be prepared or reviewed for the actual circumstances. Overseas documents may need additional formalities before they can be relied upon in Pakistan.
3. Nikah Solemnisation
The Nikah is solemnised according to the parties’ applicable Muslim personal-law requirements. The way consent, representation, witnesses and any other school-specific requirements are handled should reflect the relevant legal and religious framework rather than a standard script.
4. Nikah Nama Completion
The prescribed Nikah Nama should record the parties’ correct names, parentage, identity numbers, addresses, marital status, dower terms and other relevant entries. Important clauses should be understood before signature because they may later affect substantive family-law rights.
5. Registration Through the Competent Authority
After solemnisation, the marriage record is processed through the authorised Nikah Registrar and competent local authority according to the applicable procedure. A video call or remote ceremony does not by itself produce a registered civil record.
6. MRC and Later Government Processes
After the required registration formalities, a computerised Marriage Registration Certificate may be obtainable through the competent civil-registration process. Later NADRA identity updates, family-tree changes, MOFA attestation, apostille, embassy and immigration requirements are separate steps.
Witness and Religious Requirements
Witness and ceremony requirements are not identical across all Muslim schools. Sunni and Shia personal-law approaches differ, and individual circumstances can also affect the appropriate arrangement. Previously Married Parties
If either party was previously married, the relevant record should be reviewed before a new Nikah is arranged. Depending on the circumstances, this may include Talaq and Union Council or Arbitration Council documentation, a Family Court Khula or dissolution decree, or a former spouse’s death certificate.
Where a Muslim man already has a subsisting marriage, section 6 of the Muslim Family Laws Ordinance, 1961 and the Arbitration Council permission framework should also be considered.
Interfaith or Foreign-National Cases
Interfaith and foreign-national marriages require a more careful review than an ordinary same-faith local Nikah. Religious eligibility, nationality, identity documents, prior marital status, visa status, registration requirements and intended overseas use can all affect the appropriate route. No one-line religious or legal formula should be used to promise that every interfaith case can be processed in the same way.
