What is Nikah and Pakistani Nikah Nama Form?
‘Nikah’ means Muslim marriage in Arabic, and is mentioned in the Holy Quran. In a religious sense, marriage is a Nikah and there are no particular rituals that have to be performed. In spite of religious and social restrictions, Muslim marriage is a contract which has the following requisites:
- It involves a declaration of marriage (Ijab) by one party and its acceptance (qabool) by the other party, both having the capacity to marry and both expressing this acceptance at one time. Offers can be made by either party.
- The free and full consent of both parties (a guardian can marry a minor without invalidating the marriage, although he or she is liable under the Child Marriage Restraint Act 1929 (CMRA))
- It is mandatory that there are at least two adult, sane Muslim witnesses (one man and two women).
The Offer and Acceptance for Islamic Online Nikah, Before Filling of Nikah Nama Form
It is necessary to perform the Islamic Nikah in one sitting. Considering that the offer and acceptance of the Nikah can also be done through the representative (vakeel) as well, before filling the official Nikah Nama Form. The Nikah can be performed by either party over the phone or via Skype if either party is not physically present at the ceremony itself (Online Nikah). It is common for one party and the representative of the other party to come together in one place, and the other party (whose representative is present) is contacted over the phone or via Skype. In front of witnesses, the representative fulfills the responsibilities of the actual party regarding offer and acceptance. In Pakistan, such marriages are recognized. There are many legal jurisdictions that do not recognize such a marriage, which is often referred to as a proxy marriage, regardless of whether it is recognized under the law of the country where it was solemnized or not.
Minimum Age for Muslim Marriage (Islamic Nikah) to be written in the Nikah Nama Form
Nikah Nama Form should be filled in the column for the ages of the bride and groom. According to the Child Marriage Restraint Act (CMRA) 1929, the Federal Shariat Court (FSC) decided in October 2021 that the minimum age limit for the marriage of a girl should be 16 years, while the minimum age limit for the marriage of a boy should be 18 years. Besides age other factors also include that:
- Gender: There should be two people, one of whom should be male and the other should be female.
- Mental Capacity: There must be no mental impairment on the part of either party.
Religion: The parties must be Muslims, or one of them may be a Muslim man and the other may be an Ahlul-Kitab or Kitabia (follower of a revealed religion) woman. In Pakistan, Muslim law does not recognize the marriage of a Muslim woman to a non-Muslim man, even if he is a Ahlul-kitab man, as being allowed under Muslim law.
Consent of Marrying Couple For Islamic Nikah
In order to be legally binding, all formalities and conditions must be agreed upon by both parties freely and voluntarily. A clear consent needs to be given, without any ambiguity. One’s acceptance is an open and conscious expression without any external pressure or intimidation. It is invalid to enter into a marriage without consent or to acquire consent by force, coercion, fraud, or misrepresentation. All terms and conditions of the Nikah have to be recorded in the Nikah Nama Form.
Penalties May be Imposed on Forced Marriages and Getting Signature Forcibly by the Bride or Groom on the Nikah Nama Form
There will be criminal penalties if a woman is forced to marry against her will or getting signature or thumb impression of the bride or the groom on the Nikah Nama Form. The offenders will be prosecuted for this offences in court. Marriages registered under the law can be declared null and void by the Family Court even if the woman obtained a decree declaring them null and void.
A decree like this is known as a jactitation of marriage. It is possible to make the registrar a party to the proceedings if the forced marriage falls within the scope of the offence of forced marriage as defined by the Penal Code. In the absence of that, it is unlikely.
A question will again be raised about the validity of the marriage. As an alternative but still to the above, in the event that the marriage in question was not a forced marriage according to the Penal Code and the bride was unhappy with a particular condition but did not raise it during the wedding ceremony and signed the Nikah Nama, then the registrar is not liable.
Witnesses of the Islamic Nikah Must Sign on the Nikah Nama Form
Two witnesses are required to sign on the Nikah Nama form for an Islamic Nikah (marriage) and two more witnesses are required, to testify the appointment of an attorney (Vakeel), if an online Nikah is being solemnized. During the appointment of the vakeel, it should be ensured that the witnesses to the appointment of the vakeel for the Nikah are not the same witnesses to the marriage. Nadra Marriage Registration Certificate can be applied after submitting a copy of registered Nikah Nama.
Dower or Mehar (Mahr) For Nikah Should be Mentioned on the Nikah Nama Form
Dower is an essential component of a Muslim marriage that must be fulfilled in order to be considered valid. It is a sum of money that is paid by the husband to the wife at the time of the marriage contract. The term “consideration of marriage” is often used to refer to this process. There is a mandatory requirement in Pakistan to fix this amount at the time of marriage, and the law that is applicable there requires it to be fixed at that time. In spite of the fact that it is not mentioned in the Nikah Nama form at the time of marriage and no specific amount of money or any other property is specifically mentioned, the woman’s right to claim dower is not affected regardless of the fact that the marriage contract exists.
Registration of Nikah Nama Form
In section 5 of the Muslim Family Law Ordinance 1961, it is mandated that all marriages (Nikah) conducted in accordance with Muslim Law must be registered. Every Union Council appoints a Nikah Registrar in its area for the purpose of registering Nikahs, and this Nikah Registrar is issued a license by the Union Council for the purposes of registering Nikahs. Nikah Registrar has to sign and put his stamp/seal on the Nikah Nama form and then it will be consider as authentic, otherwise it is just a incomplete document. It is the responsibility of the Registrar to either be provided with a seal or to obtain permission to use one that bears both his license number as well as the number of the Union Council. When it comes to registering a marriage and get a Nadra marriage certificate , there is no time limit associated with it, but it is advisable to register it as soon as possible.
