What the Nikah Nama Contains, How It Is Completed and Why Registration Matters

Nikah Nama in Pakistan is the prescribed written record of a Muslim marriage contract. It records the identities of the parties, representatives where applicable, witnesses, Mahr, special conditions, delegated divorce and other important entries, and it forms the foundation of the statutory marriage-registration record under section 5 of the Muslim Family Laws Ordinance, 1961.

What Is a Nikah Nama in Pakistan?

The Nikah Nama is the formal written record connected with a Muslim Nikah. It is not merely a ceremonial certificate. The prescribed form records factual particulars and contractual terms that can later affect dower, divorce, maintenance, succession, immigration, identity records and proof of marital status.

Under section 5 of the Muslim Family Laws Ordinance, 1961, every marriage solemnised under Muslim law must be registered in accordance with the Ordinance. The rules made under the Ordinance prescribe the Nikah Nama form and the registration record.

Nikah Nama, Nikah and MRC Are Three Different Concepts

What Information Does the Pakistani Nikah Nama Record?

The prescribed Form II contains 25 numbered entries and signature/seal spaces. The entries cover several different legal and factual subjects.

Names, CNIC Details and Age Should Be Checked Before Signing

Identity information should be copied carefully from reliable official documents. Incorrect names, CNIC/NICOP numbers, dates of birth or parentage can create problems when the marriage is registered, when an MRC is generated, or when the documents are later used for immigration or identity-record updates.

The parties should also verify the current legal marriage age for the relevant province or territory rather than relying on an old specimen or generic internet article. See Legal Age for Marriage in Pakistan.

Mahr Must Be Written Clearly in the Nikah Nama

Mahr (Mehar, Mehr or dower) is a financial right of the wife arising from the Muslim marriage contract. It is not dowry. The form asks for the amount of dower, its prompt/deferred division, any amount paid at the time of marriage and property given in lieu of dower.

Section 10 of the Muslim Family Laws Ordinance, 1961 provides an important rule: where the mode of payment is not specified in the Nikah Nama or marriage contract, the entire amount of dower is presumed payable on demand.

Special Conditions Should Not Be Treated as Boilerplate

Clause 17 provides space for special conditions. Where the parties genuinely agree to lawful conditions concerning residence, finances, education, employment, property or another matter, the wording should be clear and understood before signing.

Copying another couple’s conditions can create ambiguity. Not every private condition can conclusively determine every future legal issue, and clauses should be drafted in light of applicable law.

Delegated Divorce and Clause 18

The prescribed Nikah Nama asks whether the husband has delegated the power of divorce to the wife and, if so, under what conditions. This is commonly associated with Talaq-e-Tafweez.

Clause 18 should not be crossed out automatically merely because that is someone’s routine practice. The parties should understand the option and record their actual agreement.

Second Marriage Entries in the Nikah Nama

Clauses 21 and 22 address an existing wife and the Arbitration Council permission/communication relevant to another marriage during a subsisting Muslim marriage. Section 6 of the Muslim Family Laws Ordinance, 1961 requires the prior written permission framework of the Arbitration Council.

It is therefore inaccurate to reduce the legal issue to a simple statement that “first wife consent” alone is the statutory test. The actual section 6 procedure should be reviewed where applicable.

Vakil or Representative Entries

The prescribed form contains separate entries for a bride’s or bridegroom’s Vakil and witnesses to the appointment of the representative. These entries are relevant where lawful representation is actually used.

In an overseas or proxy case, authority should be genuine and appropriately documented. A generic scanned paper or informal message should not be assumed to be sufficient for every registration process. See our Online Nikah in Pakistan guide.

Nikah Khawan and Nikah Registrar Are Not Always the Same Role

A person may solemnise the Nikah under the applicable Muslim personal law, while the statutory marriage-registration function is associated with the licensed Nikah Registrar and the prescribed registration system. Section 5(3) specifically provides for a marriage solemnised by someone other than the Nikah Registrar to be reported to the Registrar for registration.

This is why a website should not say that every person who performs a Nikah automatically has statutory registration authority.

How the Nikah Nama Is Registered

After the Nikah Nama is accurately completed and the Nikah solemnised, the marriage should be processed through the authorised Nikah Registrar and competent local framework. The exact administrative office depends on jurisdiction.

Urdu Nikah Nama and English Translation

The prescribed Pakistani marriage record is commonly encountered in Urdu. An English translation or supporting English version can be useful for a spouse, embassy, immigration authority or foreign institution, but it should faithfully correspond with the registered source record.

An English translation is not the same document as the MRC. The receiving authority determines whether it requires the original registered Nikah Nama, certified translation, MRC, MOFA attestation/apostille or other evidence.

Nikah Nama vs “NADRA Marriage Certificate”

The MRC is a later computerised civil-registration document. It does not replace all contractual entries contained in the Nikah Nama. The phrase “NADRA Marriage Certificate” is commonly used, but the issuing authority should be identified from the competent civil-registration process rather than assuming that NADRA itself solemnises or registers the Nikah.

Corrections to a Nikah Nama or MRC

If a name, identity number, date or another entry is wrong, first identify which official source record contains the mistake. If the registered Nikah Nama/register entry is wrong, the correction generally needs to begin with the marriage-registration authority. If the Nikah Nama is correct but a later MRC contains a data-entry mistake, the civil certificate correction should follow the issuing authority’s procedure.

Do not alter scans, PDFs or printed certificates privately to make records appear consistent.

Duplicate or Lost Nikah Nama

Where the marriage was properly registered, the relevant official register entry may be traceable and a copy/certified record may be available through the prescribed process. Older marriages can require manual record tracing.

A missing original should not be “recreated” from memory with a new date. The lawful registered record should be traced wherever possible.

11. What if the Nikah Nama contains an error?

The source record should be formally corrected through the responsible authority rather than privately altered.

12. What if our original Nikah Nama is lost?

If the marriage was registered, the official record may be traceable and a lawful copy/certified entry may be obtainable through the competent authority.

13. Is Mahr the same as dowry?

No. Mahr is the husband’s marital financial obligation to the wife. Dowry is a different concept.

14. Does section 6 simply require the first wife’s signature?

No. Section 6 creates a prior written Arbitration Council permission framework for another marriage during a subsisting Muslim marriage.
